All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Canada. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Certain parts of this website and Food Services social media accounts may offer the opportunity for users to post and exchange opinions, information, material and data (e.g., ‘Comments’). Food Services does not screen, edit, publish or review Comments prior to their appearance on the website and Comments do not reflect the views or opinions of Food Services, its agents or affiliates. Comments reflect the view and opinion of the person who posts such view or opinion. To the extent permitted by applicable laws, Food Services shall not be responsible or liable for the Comments or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance of the Comments.

Food Services reserves the right to monitor all Comments and to remove or hide any Comments which it considers in its absolute discretion to be inappropriate, offensive, spam or otherwise in breach of these Terms and Conditions in addition to the original social media channel’s terms and conditions.

• You are entitled to post the Comments on our website and social media accounts and have all necessary licenses and consents to do so;

You agree that Food Services and its affiliates, colleges, schools, governors, directors, officers, employees, representatives, licensors and licensees (collectively, the “Releasees“) shall not be liable to you for any damages of any kind arising from your use of the Website, any Food Services Products or Food Services or any Linked Sites or your reliance on any Website Content. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including, but not limited to, direct, indirect, special, incidental, consequential or punitive damages. In no event shall Food Services’ total liability to you for all damages, losses, and causes of action, whether in contract, tort (including but not limited to negligence) or otherwise, exceed any amounts paid by you to Food Services to access the Website in the month immediately preceding the event giving rise to such liability.

Content Liability

We shall have no responsibility or liability for any content appearing on your website. You agree to indemnify and defend us against all claims arising out of or based upon your website. Product Pricing on Website/Email/Social Media/Mobile App

Food Services strives for accuracy in advertising, however product information, pricing and availability are subject to change without notice. Pricing in Dining Halls and Retails locations is deemed accurate and final. Food Services reserves the right to end any and/or all promotions at any time.

Jurisdiction

Food Services operates and controls the Website and its Mobile App from within the province of Ontario. The Website can be accessed from all provinces and territories of Canada as well as from other countries around the world. Each of these places may have laws that differ from those of the province of Ontario, but by accessing the Website, the user agrees that all matters relating to access to, or use of, the Website shall be governed by the laws of the province of Ontario. Access to the Website, Website Content, Food Services Products or Ancillary Services is not permitted where prohibited by law. The user also agrees to submit to the exclusive jurisdiction and venue of the courts of the province of Ontario and acknowledges that he or she does so voluntarily and is responsible for complying with local laws.

U of T Mobile Order App

Food Services utilizes the services and technology from Transact Campus Inc to provide the U of T Mobile Order App. Collectively Food Services and Transact Campus Inc (“us”, “we”, or “our”) manage the content and collect personal information through the mobile app at different levels.

The U of T Mobile Order App is operated by Transact Campus Inc. is a subsidiary of Transact Holdings Inc. Transact collects personal information in the course of providing its products and services to Clients. This information may include account usernames and passwords; student and employment identification numbers; payment information, event and class information, and location information.

Types Of Information We Collect

Transact collects information from you and about you when you download the app, purchase products using their app and/or platform. Here are some examples of the information we may collect:

• Contact Information. For example, we may collect your name, mailing address, telephone number and email address. 
• Account Information. We may collect your account username and password. 
• Payment Information. For example, we may collect your billing address and payment information. This may include payment card numbers, expiration dates and security codes.
• Commercial Information. We may collect information that could identify you and relates to the products or services in which you are interested, or have considered or purchased. 
• Device Information. We may collect the type of device you use to access our Platform. We may also collect your device identifier, IP address, browser, cookie information or information about your device’s operating system. We may also collect information about your Wi-Fi network.
• Technical Information. If you use our website, we may collect information about the browser you are using. We might look at what site you came from, or what site you visit when you leave us. 

How we use the information we collect

We use your information to deliver personalized services to you.  By providing your e-mail address or other personal information to us, it will be used only by us and only in response to a request by you.
Any and all information collected via the U of T Mobile Order App and the Transact platform are kept strictly confidential and will not be sold, reused, rented, loaned, or otherwise disclosed. Any information you give to us will be held with the utmost care, and will not be used in ways that you have not consented to, unless required by law. It is our policy to secure any information collected and use it only to provide information and services directly related to our contractual agreements.

SECURITY

The Internet is not 100% secure. We cannot promise that your use of our Platform will be completely safe. We encourage you to use caution when using the Internet. We use reasonable means to safeguard personal information under our control.  A username and password are needed to access certain areas of the Transact Platform. It is your responsibility to protect your username and password.

Consent

By using the U of T Mobile Order App and the Transact platform, you consent to the collection, use, and storage of your personal and non-personal information as described above in addition to the TCards and TBucks policy.
